TimberFax Terms of Service
Effective April 30, 2026.
1. The service
TimberFax is a software-as-a-service application that lets log-home and timber-frame-home owners, contractors, and operators record and review home maintenance history through a web interface and NFC-tagged physical labels (collectively, the “Service”). The Service is operated by the individual or entity that deployed this instance (“TimberFax,” “we,” “us”).
By creating an account, signing in, submitting a contractor application, or otherwise interacting with the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract in your jurisdiction. You are responsible for keeping your account credentials confidential and for everything that happens under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
Contractor accounts are created only after an admin approves a public contractor application. We may decline or revoke any application at any time, with or without cause. Approval does not constitute an endorsement of a contractor’s skill, licensing, or work product.
3. Accuracy of records
Maintenance records, photographs, material details, and other information stored in TimberFax are entered by users (admins, contractors, or homeowners). We do not verify the accuracy of any record. You are solely responsible for the accuracy, completeness, and legality of any information you submit.
Service-due dates, overdue alerts, and recurring-maintenance recommendations are calculated automatically from the data on file. They are estimates only and are not a substitute for professional inspection or judgment.
4. NFC tags
NFC tags issued through TimberFax are physical adhesive labels intended for outdoor or interior mounting on residential structures. We make no warranty of any kind regarding the durability, weather resistance, useful life, or scan reliability of the tags. You are responsible for proper installation, ongoing inspection, and replacement when needed.
5. Acceptable use
You agree not to: (a) use the Service to violate any law; (b) attempt to access accounts, data, or systems you are not authorized to access; (c) interfere with or disrupt the Service; (d) reverse engineer, scrape at scale, or otherwise misuse the Service’s API or interface; (e) upload malware, infringing content, or sexually explicit imagery; (f) impersonate another person, business, or government.
We may suspend or terminate any account, with or without notice, for any violation of these Terms.
6. Content and licenses
You retain ownership of the content you submit to TimberFax, including photographs, notes, business descriptions, and contact information. You grant us a worldwide, royalty-free license to host, display, transmit, and back up that content for the purpose of operating the Service. We do not sell your content to third parties.
7. Third-party services
The Service relies on third-party providers (currently including Amazon Web Services for hosting and database, Cloudflare for content delivery, and Resend for transactional email). Those providers’ uptime and policies are outside our control.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF DATA LOSS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TIMBERFAX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
10. Indemnification
You agree to defend, indemnify, and hold harmless TimberFax, its operators, affiliates, and agents from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) any content you submit, (c) your violation of these Terms, or (d) your violation of any law or third-party right.
11. Termination
You may stop using the Service at any time and may request account deletion at [email protected]. We may terminate or suspend access at any time for any reason. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
12. Changes
We may modify these Terms at any time. Material changes will be announced via the Service or by email when reasonably possible. Your continued use after changes take effect constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the U.S. state in which TimberFax’s operator is established, without regard to its conflict-of-laws principles. The exclusive venue for disputes is the state and federal courts located in that jurisdiction.
